Work Package 6 – Withdrawal

The objectives of this work package are to review the state-of-the-art , collect and evaluate practices in various European countries based on the former related studies, assessment of the effect of various strategies regarding withdrawal of driving licence with focus on the conditional driving license withdrawal and development of recommendations with a comprehensive view on the entire problem.

State of the art regarding withdrawal of driving license in connection to sanctions for impaired driving

An overview of the relevant procedures regarding withdrawal and regranting of driving licenses will serve three goals:

  • To provide data for international comparisons of procedures, sanctions and various preventive measures, for example restricted driving while under treatment by various medicines.
  • To provide reliable data for the orientation of administrators, politicians and researchers enabling them to relate their practice, decisions and findings to the background procedures.
  • To set the basis for evaluation and future approximation to best practice.

Data will be collected with the questionnaire. The questionnaire will cover the items used before as well as additional items such as the use of alcohol ignition interlock systems in the prevention of impaired driving recidivism. A second, mainly evaluative questionnaire will be developed in order to obtain information on the effects of relevant procedures and sent out to executive administrators, courts and optionally to driving school instructors.

In order to evaluate the various strategies of conditional withdrawal of the driving licence or of the restrictions, the data collected will be analysed in a qualitative way.

A close co-operation between work package 6, work package 1 and work package 2 and work package 5 is important to include information from epidemiological and experimental studies into the recommendations developed in Task 6.2.

Recommendations

The aim of recomondation is not the singular focus on withdrawal legislation, but the comprehensive view on the entire problem. This analysis will aim at exploring the effects of withdrawal as one of the measures to reduce impaired driving while preserving the greatest mobility and on the same time reduce the accident risk while impaired.

In order to work out recommendations, it is necessary that results from other tasks are available.

Task 6.2 should among other things process data from Task 6.1 "State of the art regarding withdrawal of driving license in connection to sanctions for impaired driving" (legislation of the EC members States and some other European Countries and the existing practises on withdrawal, number of controls, number of withdrawals, duration of withdrawal, procedure of administration and courts, sanctions, for example level of fines, handling of withdrawal, prison or the management of psychological assessment). Information from Task 2.1 "Epidemiological studies, state of the art and planning for road side surveys and hospital case studies", Task 2.2a "Prevalence of alcohol and/or various psychoactive substances among the general driving population", work package 3 "Enforcement", Task 5.1 "State of the art" concerning Rehabilitation and Task 5.2 "Good practice" concerning Rehabilitation. A close co-operation with Task 1.3 "Recommendation of thresholds" and 1.4 "Integration of results and recommendation for further regulations" is necessary.

The goal of work package 6 will be obtained by means of the results from Task 6.1. Workshops with invited bodies from the field of legislation and rehabilitation will be carried out and serve as basis for the recommendations. Workshops will be arranged and reported by KfV in co-operation with SPV. Other partners are to contribute in the workshops with presentations, papers and discussions.
